The current version would show 3.3.8.1. Install the file and see what it says. Perhaps the .dmg is just mislabeled.

The installer downloaded by the Flip4Mac System pref pane is version 3.3.7.3 when run from an install of 3.3.7.3
You might want to correct the incorrect behavior of the updater checker...
Yes, the 3.3.8 download is available by seeking it out from the website.
